General Terms and Conditions of Sale
Version in force as of 4 October 2026 — reference v2.1
These general terms and conditions of sale (the “Terms”) are entered into between:
OLAB, société par actions simplifiée (simplified joint-stock company under French law) with a share capital of €100,000, registered with the Montpellier Trade and Companies Register (RCS) under number 978 107 720, with its registered office at 42 rue de l'Aiguillerie, 34000 Montpellier, France — intra-community VAT number FR34978107720 — Telephone: +33 4 11 93 84 24 — Email: [email protected] (hereinafter “SPLIFF” or “the Seller”),
and any adult natural person acting as a consumer who wishes to make a purchase on the spliffstore.eu website (hereinafter “the Customer”).
Article 1 — Purpose and acceptance
These Terms govern all sales concluded on the spliffstore.eu website. Any order implies the prior, express and unreserved acceptance of the Terms, recorded by confirming the order with the order button stating the obligation to pay; a link to these Terms appears immediately above that button. The applicable Terms are those in force on the date of the order; SPLIFF archives them and can provide them on request.
The Customer declares that they: (i) are at least 18 years old; (ii) have full capacity to enter into contracts; (iii) are acting for strictly personal purposes, with no direct connection to any professional activity.
Article 2 — Age requirement: no sales to minors
The sale of all products on the website to minors is strictly prohibited. This prohibition arises in particular, for vaping products with or without nicotine, from Article L.3513-5 of the French Public Health Code (Code de la santé publique) and from the equivalent regulations of the delivery countries; SPLIFF applies it to its entire catalogue. The Customer certifies that they are an adult with each order by ticking the mandatory box “I confirm that I am 18 years of age or older.” displayed before payment. SPLIFF reserves the right to request proof of identity at any time and to cancel (with a refund) any order where there is doubt as to whether the Customer is an adult. Any false declaration engages the liability of the person making it.
Article 3 — Products
3.1 Nature of the products
The products offered are products derived from hemp (Cannabis sativa L.) and its derivatives: flowers, resins, extracts and concentrates, nicotine-free vaping products, pre-rolled products, infusion products, edibles and accessories. Each product page specifies its essential characteristics: product category, quantity, origin and precautions for use.
“THCX” is a trade name, not a molecule: the exact formulation of the products marketed under this name is a trade secret of SPLIFF and its suppliers. The Customer is expressly informed of this proprietary nature before purchase. These products have psychoactive effects; the warnings in Article 4 apply to them in full.
3.2 THC content and laboratory testing
Flowers and resins have a delta-9-THC content below 0.3%; vaping products contain 0% THC.
Each batch of products in the THCX range is tested by an independent third-party laboratory to detect the presence of substances listed on the French lists of narcotic and psychotropic substances (in particular the synthetic and semi-synthetic cannabinoids classified by ministerial order, such as HHC, HHC-O, HHCP, THCP, H4CBD and related molecules). Only batches with a negative screening result are placed on sale. The screening reports are available on simple request to [email protected].
As cannabinoid regulations are constantly evolving, SPLIFF carries out continuous regulatory monitoring (in particular of ANSM classification orders), immediately withdraws from sale any product one of whose components becomes classified, and undertakes not to ship any pending order for such a product (the order is then refunded in full).
3.3 No therapeutic purpose
The products sold on the website are not medicines and are not the subject of any therapeutic claim. They are not intended to diagnose, treat, cure or prevent any disease. The descriptions published on the website are for commercial purposes only and in no way constitute medical advice.
3.4 Photographs
The photographs and visuals illustrating the products are as faithful as possible. The essential contractual characteristics are those described on the product page; minor variations in appearance (colour, shape of the flowers, etc.) inherent to natural products do not constitute a lack of conformity.
Article 4 — Health warnings and responsible use
The Customer acknowledges having read the following warnings, which are also displayed on the website:
- Products for adults only. Keep out of the reach of children and animals.
- Driving and machinery: DO NOT DRIVE or operate machinery after consumption. Products containing cannabinoids, including those with a low THC content, may cause a positive result in saliva, urine or blood screening tests. Driving after using substances detected as narcotics is a criminal offence (Art. L.235-1 of the French Highway Code, Code de la route, and foreign equivalents), regardless of the nature of the product purchased. SPLIFF cannot guarantee that nothing will be detected.
- Pregnancy and breastfeeding: consumption not recommended. Medical advice is essential.
- Medical treatments and conditions: risk of drug interactions; consult a healthcare professional before any consumption.
- Individual effects vary: the effects, their intensity and their duration vary depending on the person, the method of consumption and the dosage. Start with the lowest dose; for edibles and concentrated extracts, wait until the effects have fully set in (up to 2 hours for an edible) before taking any more.
- Combustion is harmful to health. Products presented as “for infusion” or “aromatic” are not intended to be smoked.
- Do not combine with alcohol or other psychoactive substances.
- Excessive or inappropriate use may cause adverse effects (drowsiness, dizziness, anxiety, tachycardia…). In the event of a serious adverse effect: stop consumption and contact a doctor or a poison control centre.
Article 5 — Prices
Prices are expressed in euros, all taxes included (VAT at the rate in force on the day of the order). They do not include delivery charges, which are shown before the order is confirmed. SPLIFF may change its prices at any time; the applicable price is the one displayed on the day of the order.
Delivery charges: delivery is free for purchases of €99 or more, for all destinations served. Below this amount: mainland France — €3.99 to a pickup point, €4.99 to your home; other countries served — €5.99 to a pickup point, €6.99 to your home. Home deliveries are handed over against signature.
Article 6 — Orders and payment
The ordering process is as follows: basket → contact details (with or without creating an account) → address and delivery method → summary → certification that the Customer is an adult via the mandatory box “I confirm that I am 18 years of age or older.” → confirmation of the order with the order button stating the obligation to pay, which constitutes acceptance of these Terms, accessible via a link immediately above that button → payment. The order is only final once payment has been confirmed; a summary email is sent to the Customer.
Payment is made by bank card through the secure payment providers PayZen (Lyra) and Viva Wallet (3-D Secure protocol). The amount is debited when the order is confirmed. SPLIFF reserves the right to refuse or cancel any order in the event of a previous payment dispute, suspected fraud, an order clearly intended for resale, or a destination in a country not served (Article 8).
Article 7 — Retention of title
The products remain the property of SPLIFF until the price has been paid in full. This retention of title does not affect the transfer of risk provided for in Article 8.4.
Article 8 — Delivery
8.1 Delivery area
SPLIFF delivers to mainland France and to the European countries listed on the website's Delivery and returns page. SPLIFF reserves the right to refuse or cancel the shipment of certain product categories to certain countries where local regulations so require or are subject to serious uncertainty; the order is then cancelled and refunded in full. The list of destinations served may be updated at any time.
8.2 Carriers and delivery times
Deliveries are made by GLS, to the Customer's home (handed over against signature) or to a pickup point, at the address or pickup point indicated by the Customer. Unless otherwise stated when ordering, SPLIFF delivers no later than 30 days after the order. Failing this, the Customer may, after having unsuccessfully requested SPLIFF to deliver within a reasonable additional period, terminate the contract (Articles L.216-6 et seq. of the French Consumer Code, Code de la consommation) and be refunded all sums paid within 14 days at the latest.
8.3 Deliveries outside France
For deliveries within the European Union, the prices displayed include all taxes. The Customer is informed that the regulations applicable to hemp-derived products vary from one State to another; SPLIFF endeavours not to offer products for sale to destinations where their sale is prohibited (Article 8.1). It is also the Customer's responsibility to find out about the regulations of their country of residence before ordering.
8.4 Transfer of risk
In accordance with Article L.216-4 of the French Consumer Code, the risk of loss of or damage to the products passes to the Customer when the Customer (or a third party designated by the Customer) takes physical possession of them. If a parcel is damaged or contents are missing, the Customer is invited to make reservations with the carrier and to contact SPLIFF as soon as possible; the absence of reservations does not deprive the Customer of their rights.
Article 9 — Right of withdrawal
9.1 Principle
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 calendar days from receipt of the products (or of the last product in the case of a split delivery) to withdraw, without having to give reasons for their decision.
9.2 Exceptions
The right of withdrawal cannot be exercised for (Article L.221-28 of the French Consumer Code):
- products liable to deteriorate or expire rapidly (in particular flowers, resins, fresh products and edibles) — 4°;
- products unsealed after delivery which cannot be returned for reasons of hygiene or health protection (in particular vaping products, foodstuffs, cosmetics, pre-rolled products whose seal has been broken) — 5°.
Products excluded from the right of withdrawal are indicated as such on the relevant product page.
9.3 Procedure
The Customer notifies their withdrawal by an unambiguous statement (email to [email protected] or letter), and may use the model form reproduced in the annex to these Terms. The Customer returns the products, complete, sealed and in their original packaging, no later than 14 days after their notification, to: OLAB — 42 rue de l'Aiguillerie, 34000 Montpellier. Return costs are borne by the Customer. SPLIFF refunds all sums paid, including the initial delivery charges (at the standard rate), no later than 14 days after recovering the products or receiving proof that they have been sent back, using the payment method used for the order.
Article 10 — Statutory warranties
All products automatically benefit from:
- the statutory guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code) — valid for 2 years from delivery, with a presumption that the defect already existed during 24 months, repair/replacement then price reduction or termination, at no cost to the Customer;
- the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code, Code civil) — 2 years from discovery of the defect.
Mandatory notice (Article D.211-2 of the French Consumer Code):
The consumer has a period of two years from delivery of the goods to obtain the implementation of the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared. Where applicable, the statutory guarantee of conformity obliges the seller to provide all the means necessary to put the goods into service. The consumer benefits from a six-month extension of the initial guarantee on the goods if the goods are repaired under the statutory guarantee of conformity. The consumer may obtain replacement of the goods if the repair is not carried out within thirty days of their request or if it causes them major inconvenience. If the goods are replaced, the replacement starts a new guarantee period. A consumer who wishes to obtain a price reduction or termination of the contract in the event of a significant lack of conformity may do so under the conditions laid down by law. The consumer may also invoke the statutory guarantee against hidden defects within the meaning of Article 1641 of the French Civil Code, within two years of discovering the defect, and choose between termination of the sale or a reduction in the sale price.
Complaints should be sent to customer service: [email protected] or OLAB — 42 rue de l'Aiguillerie, 34000 Montpellier. SPLIFF acknowledges receipt of them and handles them as quickly as possible.
Article 11 — Liability
SPLIFF is automatically liable for the proper performance of the distance contract (Article L.221-15 of the French Consumer Code), unless it proves that the non-performance is attributable to the Customer, to the unforeseeable and insurmountable act of a third party unconnected with the supply, or to force majeure.
SPLIFF cannot be held liable for:
- damage resulting from use of the products not in accordance with the precautions for use and warnings (Article 4), in particular consumption by a minor to whom the Customer has given the product, driving after consumption, deliberate overdose, mixing with other substances;
- the consequences of a legislative or regulatory change after the sale affecting the possession or use of the products, subject to the commitments in Article 3.2;
- damage related to the use of the Internet (loss of data, intrusion, viruses, service interruption) that is not attributable to it.
Nothing in these Terms deprives the Customer of the statutory warranties or limits SPLIFF's liability in the event of fraud, gross negligence, personal injury or under the rules on defective products (Articles 1245 et seq. of the French Civil Code).
Article 12 — Customer obligations — international orders
The Customer undertakes to: (i) order only for their personal consumption, in quantities compatible with such use; (ii) not resell the products; (iii) not give them to minors; (iv) check, before any order to a country other than France, that the import, possession and use of the products ordered are permitted there. SPLIFF does not guarantee that the products comply with the specific national laws of each destination country, which may differ (permitted THC content, status of flowers, status of derived cannabinoids).
If the Customer orders to a country where the product turns out to be prohibited or restricted, the Customer bears the consequences (retention, seizure or destruction of the parcel by the local authorities, penalties against the Customer), without prejudice to their rights under the statutory warranties for any other cause. In the event of an inspection or customs retention, SPLIFF works with the Customer to document the characteristics of the products shipped (analysis reports, invoices).
Article 13 — Intellectual property
All elements of the spliffstore.eu website (trademarks, logos, texts, visuals, photographs, videos, structure) are protected by intellectual property law and remain the exclusive property of OLAB or its licensors. Any reproduction or use, in whole or in part, without prior written authorisation is prohibited and constitutes infringement (Articles L.335-2 et seq. of the French Intellectual Property Code, Code de la propriété intellectuelle).
Article 14 — Personal data
The Customer's personal data are processed by OLAB, as data controller, in accordance with Regulation (EU) 2016/679 (GDPR) and the amended French law no. 78-17 of 6 January 1978, for the following purposes: management of orders and deliveries, customer accounts, after-sales service, fraud prevention and, with the Customer's consent, commercial prospecting. The Customer has the rights of access, rectification, erasure, restriction, objection and portability, which they may exercise at [email protected], as well as the right to lodge a complaint with the CNIL (cnil.fr) and to set instructions regarding their data after death. Details of the processing (recipients, retention periods, transfers) are set out in the Privacy Policy available on the website, which forms an integral part of the information provided to the Customer.
Article 15 — Consumer mediation and disputes
In the event of a dispute, the Customer first contacts customer service ([email protected]). If no amicable solution is found within 60 days, the Customer may refer the matter, free of charge, to the consumer mediator designated by SPLIFF:
CM2C — Centre de la Médiation de la Consommation de Conciliateurs de justice 49 rue de Ponthieu, 75008 Paris — https://www.cm2c.net — online referral: https://www.cm2c.net/deposer-une-demande
A Customer residing in another Member State of the European Union may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr
Governing law and jurisdiction. These Terms are governed by French law, without depriving a Customer residing in another Member State of the European Union of the protection of the mandatory provisions of the law of their country of habitual residence (Article 6 of the “Rome I” Regulation). Any dispute falls within the jurisdiction of the competent courts under ordinary law; the consumer Customer may bring proceedings, at their choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure (Code de procédure civile) or, if they reside in the European Union, before the court of their place of residence (“Brussels I bis” Regulation).
Article 16 — General provisions
These Terms are drawn up in French and translated into several languages for the Customer's convenience; in the event of any discrepancy between the French version and a translation, the French version shall prevail. If any clause of these Terms is declared null and void or deemed unwritten, the other provisions shall remain fully valid. SPLIFF's temporary failure to invoke a clause shall not constitute a waiver of it. SPLIFF's computerised records, kept under reasonable security conditions, constitute proof of communications and orders between the parties, unless proven otherwise.
