by any individual or legal entity wishing to make a purchase via the spliff.fr website, hereinafter referred to as ‘the buyer’.
Article 1. PURPOSE
The purpose of these terms and conditions of sale is to define the contractual relationship between OLAB SAS and the purchaser and the conditions applicable to any purchase made via the spliff.fr website. The acquisition of a product through this site implies unreserved acceptance by the purchaser of these conditions of sale, which the purchaser acknowledges having read prior to ordering. Prior to any transaction, the purchaser declares, on the one hand, that the purchase of products on the spliff.fr website is not directly related to his/her professional activity and is limited to strictly personal use and, on the other hand, that he/she has full legal capacity, enabling him/her to commit to these general terms and conditions of sale. OLAB SAS reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. As a result, the applicable conditions will be those in force on the date of the buyer’s order.
Article 2. PRODUCTS
The products offered are those shown on the OLAB SAS spliff.fr website, while stocks last. OLAB SAS reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics (capacity, use, composition, etc.). The photographs are as accurate as possible but are not binding on the Seller. The products offered comply with French and European legislation concerning CBD, particularly in terms of THC content, which is strictly below the legal threshold of 0.3%. The sale of the products presented on the spliff.fr website is intended for all buyers resident in countries that fully authorise the entry of these products into their territory.
Article 3. RATES
The prices shown on the product sheets in the Internet catalogue are in Euros (€), inclusive of all taxes (TTC), and include the VAT applicable on the date of the order. Any change in the VAT rate may be reflected in the price of the products. OLAB SAS reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order shall be the only price applicable to the purchaser. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In metropolitan France, for all orders, delivery costs are offered by Colissimo without signature or by Mondial Relay.
Article 4. ORDERING AND PAYMENT TERMS
Before placing an order, the buyer must create an account on the spliff.fr website. The account creation section can be accessed directly from the side menu bar. Each time they visit the site, buyers who wish to order or view their account (order status, profile, etc.) must identify themselves using this information.
Payment by credit card is secure and made via our online payment partner. Please note that your credit card will be debited immediately upon confirmation of your order. This means that the amount corresponding to your purchase will be taken immediately from your bank account when the order is confirmed. By using this method of payment, you accept that your credit card will be debited instantly and in full.
4.1. Applicable law
This contract is governed by French law. Any dispute arising from this contract shall be submitted to the exclusive jurisdiction of the French courts.

Article 5. RETENTION OF TITLE
OLAB SAS retains full and complete ownership of the products sold until full payment has been received, in principal, costs and taxes included.
Article 6. WITHDRAWAL
In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the date of delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or reimbursement without penalty, with the exception of the cost of return, which is payable by the buyer. For reasons of hygiene and safety, only sealed, unopened and unused products may be returned for retraction. Only non-perishable products may be returned. Flowers and resins, or any other edible products or products sold as flowers or resins for infusion cannot be returned due to their perishable nature and the expiry date indicated on the packaging.
Article 7. DELIVERY
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are placed by La Poste via COLISSIMO, a tracked delivery service, delivered without a signature. Delivery times are given as an indication only; if they exceed thirty days from the date of the order, the sales contract may be terminated and the purchaser reimbursed. OLAB SAS may provide the purchaser with a parcel tracking number by e-mail. The buyer is delivered to his/her home by his/her postman. If the purchaser is absent, he/she will receive a delivery notice from the postman, which will allow him/her to collect the products ordered from the nearest post office, during a period indicated by the postal services. The risks associated with transport are borne by the purchaser from the moment the items leave the premises of OLAB SAS. The purchaser is obliged to check the condition of the packaging of the goods and their contents on delivery, in the presence of the employee of La Poste or the delivery person. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
Article 8. GUARANTEE
All products supplied by OLAB SAS are covered by the legal guarantee provided by articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to OLAB SAS, which will take it back, exchange it or reimburse it. All claims, requests for exchange or reimbursement must be made by post to the following address: OLAB SAS – 42 rue de l’Aiguillerie 34000 Montpellier, within thirty days of delivery. Complaints must be sent in writing to OLAB SAS with a detailed description of the problem and proof of purchase. Complaints will be processed within 30 days of receipt.
Article 9. LIABILITY
In the distance selling process, OLAB SAS is only bound by an obligation of means. It may not be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems. OLAB SAS cannot be held responsible for legislative or regulatory changes affecting the marketing, importation or use of CBD products.
Article 10. INTELLECTUAL PROPERTY
All elements of the spliff.fr website are and remain the exclusive intellectual property of OLAB SAS. No one is authorised to reproduce, exploit or use for any purpose whatsoever, even partially, any elements of the site, whether in the form of photos, logos, visuals or text.
Article 11. PERSONAL DATA
OLAB SAS undertakes to maintain the confidentiality of any information provided by the purchaser, which he/she may be required to transmit in order to use certain services. Any information concerning the purchaser is subject to the provisions of law no. 78-17 of 6 January 1978. As such, Internet users have the right to access, modify and delete information concerning them.

Article 12. SETTLEMENT OF DISPUTES
These conditions of distance selling are governed by French law. For all disputes or litigation, the competent court will be that of Montpellier. It is the buyer’s responsibility to check local legislation concerning CBD products and to inform OLAB SAS of any restrictions. In the event of non-compliance, OLAB SAS declines all responsibility, and the purchaser assumes all legal consequences.
Article 13. Health warnings and recommendations
Pregnant or breastfeeding women, as well as people undergoing medical treatment, are strongly advised to consult a health professional before using CBD products.
Article 14. BUYER’S LIABILITY
The buyer assumes full responsibility for verifying and complying with the applicable laws and regulations of his/her country regarding the importation, purchase and use of CBD products offered by Spliff, a company based in France. In the event of seizure, confiscation or any other action by local customs or legislative authorities, Spliff declines all responsibility. We remind our international customers to familiarise themselves thoroughly with the laws in force in their country before making a purchase.
Furthermore, Spliff cannot be held responsible for any legal consequences resulting from the purchase or use of our CBD products abroad. This includes any legal measures, fines, or other sanctions imposed by local authorities. It is the responsibility of the purchaser to comply strictly with all applicable regulations and to take the necessary precautions to avoid any legal problems.
In the event of a dispute, the buyer agrees to hold Spliff harmless, and agrees to cover any legal fees, fines or other costs resulting from its failure to comply with local laws.
